By accessing or using Training Yard ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
Training Yard is a fitness training application that provides personalized workout programming, progressive overload tracking, and training analytics. The Service is available via web browser and as a mobile application.
3. Account Registration
- You must provide a valid email address and create a password to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 13 years old to create an account.
- You agree to provide accurate, current, and complete information.
- You are responsible for all activity that occurs under your account.
4. Subscriptions and Payments
Free Trial
New users receive a 14-day free trial with full access to all features. After the trial period, a paid subscription is required to continue logging workouts and creating programs.
Paid Subscriptions
- Subscriptions are billed on a recurring basis (monthly or yearly).
- Payments are processed securely through Stripe (web) or Apple App Store (iOS).
- Prices are displayed before purchase and may change with notice.
Cancellation
- You may cancel your subscription at any time from the Settings page or through your payment provider.
- Cancelled subscriptions remain active until the end of the current billing period.
- No refunds are provided for partial billing periods.
- For iOS subscriptions, cancellation must be done through Apple's subscription management.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated scripts, bots, or scrapers to access the Service
- Share your account credentials with others
- Create multiple accounts to abuse free trials or promotions
6. Health and Fitness Disclaimer
Training Yard is not a substitute for professional medical advice, diagnosis, or treatment. The workout programs and recommendations provided by the Service are generated algorithmically based on your input data and general exercise science principles. You should:
- Consult a healthcare professional before starting any exercise program
- Stop exercising immediately if you experience pain, dizziness, or discomfort
- Use proper form and technique when performing exercises
- Understand that results vary based on individual factors
We are not liable for any injuries, health issues, or damages that may result from following workout programs generated by the Service.
7. Intellectual Property
- The Service, including its design, code, algorithms, and content, is owned by Training Yard and protected by intellectual property laws.
- Your workout data and personal information remain yours. You grant us a limited license to use this data solely to provide the Service.
- You may not copy, modify, or distribute any part of the Service without written permission.
8. Account Deletion
You may delete your account at any time from the Settings page. Upon account deletion:
- All personal data, workout history, and training programs will be permanently deleted.
- Active subscriptions will be cancelled.
- This action is irreversible and cannot be undone.
- Data deletion will be completed within 30 days.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or other operational reasons. We are not liable for any loss of data or interruption of service.
10. Limitation of Liability
To the maximum extent permitted by law, Training Yard and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
